WHEREAS per Section 804.2 of the Local Government Act if, in respect of a year, the share of the cost of all services of the regional district that was apportioned to and borne by a municipality in that year would, had those adjustments been taken into account, have increased or decreased by more than 1,000, and that cost must be adjusted in a manner directed by the Minister in the next requisition after the adjustment; AND WHEREAS under Section 805 of the Local Government Act the amount requisitioned by the regional district is a debt due by the municipality to the regional district and the council must pay it to the board on or before August 1 of the current year: THEREFORE BE IT RESOLVED that UBCM be requested to urge the provincial government to review Section 804.2 of the Local Government Act as it creates an inequity between regional districts and municipalities by placing a financial hardship on municipalities when they must continue to pay the higher assessed rate until the final revised supplementary supplied by the BC Assessment Authority is made known.

MINISTRY OF COMMUNITY SERVICES The Ministry of Community Services Ministry recognizes the need to examine Section 804.2 of the Local Government Act. The Ministry has started to review how the Section should be applied in certain circumstances. It is the goal of this examination to ensure that the assessment, taxation and appeal systems are flexible, fair and equitable to the taxpayer and to local governments. Consultations with BC Assessment, local governments and the Union of British Columbia Municipalities will be undertaken during the review.
