WHEREAS the Homeowner Protection Act requirements are resulting in unintended negative impacts such as the removal and disposal rather than repair of wood windows from heritage buildings in Port Moody; AND WHEREAS traditional components of heritage buildings have demonstrated their sound performance over decades of use; THEREFORE BE IT RESOLVED that the Province of British Columbia exempt heritage buildings from the specific requirements of the Homeowner Protection Act to ensure that their heritage character is not compromised by the needless removal of their character defining elements.

Provincial Response

Ministry of Tourism, Culture the Arts An amendment was made to the Homeowner Protection Act Regulation by Order-in-Council on June 24, 2010, that aligns the objectives of homeowner protection and historic place conservation. Staff of the Homeowner Protection Office, working with the Ministry of Tourism, Culture the Arts Heritage Branch, are preparing guidance on the amendment.
