WHEREAS the Assessment Act requires the assessor to re-assess properties that were assessed for less than the amount of their value and provide this updated assessment in a supplementary roll; AND WHEREAS section 241 of the Community Charter requires for taxes that are to be imposed on the basis of a supplementary roll under the Assessment Act, 30 days notice must be given for payment of those taxes and a penalty must not be added in that period and if an assessment on a supplementary roll is set aside or if the assessed value is reduced, the municipality is required to refund the owner the excess amount of taxes and any penalty and interest on the excess; AND WHEREAS supplementary rolls issued after July 1 create a financial hardship for: - property owners since there is a short time frame to pay the additional taxes due without incurring a penalty - the municipality if a refund is required since the annual budget is passed in May and is calculated using the assessment roll provided by BC Assessment: THEREFORE BE IT RESOLVED that the UBCM request the Province of BC to amend the Community Charter to reflect that supplementary assessment rolls completed after July 1 will be the properties assessment for the subsequent year.
