WHEREAS the number of lawsuits against local governments for injury claims by individuals who refuse to accept responsibility or be accountable for their own actions is rising at an alarming rate; AND WHEREAS insurance costs to local governments as a result of these increasing lawsuits are rising at an alarming rate and thereby reducing funds available for local government operations: THEREFORE BE IT RESOLVED that the Province of British Columbia introduce legislation which will allow for a means i.e., an independent tribunal to determine whether or not a litigant in a questionable case acted in a responsible manner, and the insurer then be permitted to base the amount of settlement in these cases on such findings.
